1. Overview

Bites of Goodness operate this website. Throughout the site, the terms “we”, “us” and “our” refer to Bites of Goodness. By accessing our website and/or purchasing our products, you agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including any additional terms and conditions and policies referenced herein and/or available by hyperlink.

2. Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence.

3. Local Delivery Policy

Bites of Goodness offers local delivery within a 25-mile radius of Fishers, Indiana.. Delivery details, including fees and schedules, are outlined during the checkout process.

Due to the perishable nature of our cupcakes, someone will need to be available to receive the delivery at the specified address and time. We are not responsible for product quality degradation due to unattended deliveries.

4. Order Acceptance and Cancellation

All orders are subject to acceptance by Bites of Goodness. We reserve the right to refuse or cancel any order for reasons including but not limited to: product or service availability, errors in the description or price of the product, or any other reason.

Cancellations must be made at least 12 hours prior to the scheduled delivery time to be eligible for a refund. Custom or large orders require a 20-hour notice for cancellations.

5. Product Information

We strive to display our products as accurately as possible in terms of color and image. However, we cannot guarantee that your computer monitor's display of any color will be accurate.

Our product is prepared in a facility that also handles wheat, peanuts, soy, and sesame.  Customers with food allergies are advised to contact us before placing an order.

6. Pricing and Payment

Prices for our products are subject to change without notice. We accept various forms of payment as indicated during the checkout process. Payment must be received in full before the order is processed.

7. Refund Policy

Due to the perishable nature of our products, we do not accept returns. If there is an issue with your order, such as receiving the wrong item or a damaged product, please contact us within 2 hours of delivery with a photo and description of the issue. Eligible refunds will be processed to the original payment method within 5-7 business days.

8. Intellectual Property

All content on this site, including but not limited to text, graphics, logos, images, and software, is the property of Bites of Goodness and is protected by applicable intellectual property laws.

9. User Conduct

You agree not to use our products or services for any unlawful or unauthorized purpose. You must not transmit any worms, viruses, or any code of a destructive nature.

10. Limitation of Liability

Bites of Goodness shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of our products or services.

11. Indemnification

You agree to indemnify and hold harmless Bites of Goodness and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand arising out of your breach of these Terms or your violation of any law or the rights of a third party.

12. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the United States.

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes.
